1. About Witzo

Witzo is an AI chat agent platform that allows businesses to train and deploy AI assistants using their website content and documents.

The platform enables businesses to:

• Train AI on website pages and documents
• Embed an AI chat widget on their website or Shopify storefront
• Automate responses to visitor questions
• Capture leads and monitor conversations through the dashboard

2. Account Registration

To use certain features of the platform, you must create an account, or in the case of the Shopify app, install it via your Shopify admin.

You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account

If you believe your account has been compromised, you must notify us immediately.

3. Acceptable Use

You agree not to use the Witzo platform to:

• Engage in unlawful activities
• Distribute harmful, abusive, or misleading content
• Attempt unauthorized access to systems or data
• Interfere with the functionality of the platform
• Use the service for spam, fraud, or malicious activities

We reserve the right to suspend or terminate accounts that violate these rules.

4. Subscription Plans and Billing

Witzo offers both free and paid subscription plans with different usage limits and capabilities. Paid subscriptions may include additional features such as increased usage limits, additional data sources, advanced customization, and analytics and lead tracking features.

Subscriptions may renew automatically depending on the selected billing cycle and the channel through which you subscribed (direct or Shopify).

5. Payments and Merchant of Record

How payment is handled depends on how you access Witzo:

• Direct subscriptions (witzo.ai / app.witzo.ai): payments are processed by Dodo Payments, which acts as the Merchant of Record. Dodo Payments processes payments and invoices, manages tax collection where applicable, processes refund requests, and your bank or card statement may show charges from Dodo Payments rather than Witzo. By purchasing a direct subscription, you agree to Dodo Payments' Buyer Terms:https://dodopayments.com/legal/buyer-terms.
• Shopify app subscriptions: if you install Witzo through the Shopify App Store, your subscription is billed by Shopify as part of your regular Shopify billing, using Shopify's recurring application charge system. Shopify — not Dodo Payments or Witzo — is the party you pay, and Shopify's Terms of Service and billing policies govern that charge.

6. Refunds

Direct subscriptions: Witzo offers a 14-day money-back guarantee for purchases made through Dodo Payments. If you are not satisfied with the service, you may request a refund within 14 days of the original purchase or renewal date. Refunds are processed in accordance with Dodo Payments' refund procedures and issued to the original payment method.

Shopify app subscriptions: refund requests for charges billed through Shopify are handled according to Shopify's billing and refund policies. Witzo does not process or control refunds for Shopify-billed charges; you may need to contact Shopify Support directly.

Refund requests can be submitted through Dodo Payments support, Shopify Support (as applicable), or through Witzo support channels, and we will point you to the correct process.

7. Cancellation

You may cancel your subscription at any time — through your Witzo dashboard for direct subscriptions, or through your Shopify admin for Shopify-billed subscriptions — to prevent future billing.

Cancellation stops future charges but does not affect the current billing period. Your subscription will remain active until the end of the current billing cycle.

8. User Content

When using the platform, you may provide content including website pages, documents, text data, and chat conversations. You retain ownership of your content.

By using Witzo, you grant Webomindapps permission to process and analyze this content for the purpose of providing the service.

You are responsible for ensuring that you have the rights to upload and use the content provided.

9. AI Generated Responses

Witzo uses artificial intelligence to generate responses during conversations.

AI-generated responses are based on the content available in your training sources and may not always be accurate or complete.

You are responsible for reviewing and verifying AI-generated responses before relying on them for business or operational decisions.

10. Intellectual Property

All intellectual property rights related to the Witzo platform, including software, design, branding, and technology, are owned by Webomindapps Private Limited. Users are granted a limited, non-exclusive license to use the platform according to these Terms.

You may not:

• Copy or reproduce the platform
• Reverse engineer the software
• Create derivative works without permission

11. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted or error-free operation. Service interruptions may occur due to maintenance, infrastructure issues, third-party service disruptions (including Dodo Payments, Shopify, or AI infrastructure providers), or technical failures. We are not liable for temporary downtime or loss of access.

12. Limitation of Liability

To the maximum extent permitted by law, Webomindapps Private Limited will not be liable for any indirect, incidental, or consequential damages resulting from the use of the Witzo platform. This includes loss of profits, business interruption, or loss of data. Your use of the service is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless Webomindapps Private Limited, its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the platform, your violation of these Terms, or your violation of any rights of a third party.

14. Third-Party Services

Witzo may rely on third-party services for certain functionality, including:

• Payment processing (Dodo Payments for direct purchases; Shopify for the Shopify app)
• Cloud hosting infrastructure
• AI model providers

These services operate under their own terms and privacy policies.

15. Termination

We may suspend or terminate your access to the service if you violate these Terms, fraudulent or abusive activity is detected, or the platform is misused. Termination may result in loss of access to the platform and related data.

16. Dispute Resolution

If a dispute arises out of or relates to these Terms or your use of Witzo, both parties agree to first attempt to resolve the dispute informally by contacting info@witzo.ai.

17. Changes to These Terms

We may update these Terms from time to time.

The updated version will be published on this page with the revised date. Continued use of the service after updates are published constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by the laws of India, and the courts of Bangalore, Karnataka shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms.
